These Terms & Conditions apply to all services provided by LUMA HAVEN (“we”, “us”, “our”), operated by Erika Yamada (“Practitioner”). By booking, purchasing, or receiving services, you (“Client”) confirm that you have read, understood, and agreed to these Terms.

1) Nature of Services
1.1 LUMA HAVEN provides holistic, non-medical bodywork and facial services designed to support relaxation, nervous system regulation, and restorative balance.
1.2 Services are not medical treatment and do not replace medical, psychological, or psychiatric care. We do not diagnose conditions.
1.3 Any information shared verbally or in writing is provided for general well-being support and does not constitute medical advice.

2) Eligibility
2.1 Services are offered to Clients aged 18+ unless expressly agreed in writing with a parent or legal guardian present and consented intake procedures completed.
2.2 We reserve the right to decline or discontinue service where a session is not appropriate, safe, or aligned with professional standards.

3) Booking & Appointment Reservation
3.1 Appointments are confirmed only once written confirmation (email or message) has been issued by LUMA HAVEN.
3.2 Your appointment time is reserved exclusively for you. Due to limited availability and preparation requirements, our cancellation policy is strictly applied.
3.3 We may request completion of an intake form before the first session and/or prior to specific techniques (including intra-oral work).
3.4 Where a booking is made by a third party (including but not limited to personal assistants, estate managers, family offices, security teams, or hospitality staff), the booking party confirms they are authorized to act on behalf of the Client. Financial responsibility remains with the booking party unless otherwise agreed in writing.

4) Fees, Payment & Pricing
4.1 Prices are displayed in EUR and may be updated at any time. The applicable price is the one confirmed at booking.
4.2 Full prepayment may be required to confirm your appointment. For extended sessions, peak times, or private/on-location work, a deposit may be required and will be applied toward the total fee.
4.3 Any bank or transfer fees are the Client’s responsibility unless otherwise agreed.
4.4 If payment is not received by the required deadline, LUMA HAVEN reserves the right to release the appointment without further notice.

5) Cancellation, Rescheduling & No-Show Policy
Standard Studio/Clinic Appointments
5.1 Rescheduling with 48+ hours’ notice is permitted, subject to availability.
5.2 Cancellation or rescheduling with 24–48 hours’ notice incurs 50% of the session fee.
5.3 Cancellation or rescheduling with less than 24 hours’ notice incurs 100% of the session fee.
5.4 No-show or same-day cancellation incurs 100% of the session fee.
On-Location / Private Appointments (residence, hotel, yacht, estate)
5.5 A minimum of 72 hours’ notice is required to reschedule without fee unless otherwise agreed in writing.
5.6 Travel costs, preparation expenses, logistical arrangements, and any incurred coordination fees remain payable and may be non-refundable.
Late Arrival
5.7 Late arrival shortens the session duration and does not reduce the fee. Sessions will end at the originally scheduled time.
Exceptional Circumstances
5.8 Any exceptions to this policy are granted at the sole discretion of LUMA HAVEN and do not constitute a waiver of future enforcement.

6) Client Responsibilities & Health Disclosure
6.1 You agree to provide accurate and complete health information, including injuries, surgeries, pregnancy, neurological conditions, psychological considerations, medications, allergies, and relevant diagnoses.
6.2 You must inform the Practitioner immediately of any discomfort, pain, dizziness, or adverse response during the session.
6.3 Withholding relevant health information may increase risk and may limit our ability to tailor the session safely.

7) Informed Consent & Session Experience
7.1 Sessions are body-led and may include deep tissue work, fascial techniques, breath-aware methods, abdominal work, and/or facial approaches depending on your needs and informed consent.
7.2 Temporary responses such as tenderness, fatigue, emotional release, lightheadedness, or changes in sleep and appetite may occur.
7.3 No specific outcome is guaranteed. Results vary depending on individual physiology and lifestyle factors.
7.4 Consent is ongoing and may be withdrawn at any time during the session.
Intra-Oral Work
7.5 Intra-oral techniques require explicit, separate consent on the day of treatment. You may decline without explanation.

8) Professional Boundaries & Conduct
8.1 LUMA HAVEN maintains a respectful and professional environment at all times.
8.2 Sexualized behavior, harassment, coercion, intoxication, aggression, or any boundary violation will result in immediate termination of the session. The full session fee remains payable.
8.3 LUMA HAVEN reserves the right to refuse or discontinue service if safety or professional boundaries are compromised.

9) Confidentiality & Discretion
9.1 Client privacy is treated with strict discretion. Personal information is not shared without consent except where legally required.
9.2 LUMA HAVEN does not publicly disclose client identities, booking details, or session locations.
9.3 Recording (audio, photography, or video) during sessions is not permitted without explicit written permission.
9.4 If sharing your experience publicly, you agree not to disclose sensitive operational details, including exact location or private scheduling processes.
9.5 LUMA HAVEN reserves the right to neither confirm nor deny any past, present, or prospective professional engagement with any individual or entity.
9.6 Confidentiality obligations survive termination of services.

10) Data Protection (GDPR)
10.1 Personal data is processed in accordance with EU GDPR regulations.
10.2 Data may include contact details, booking history, and intake notes required for safe service delivery.
10.3 Health-related data is treated as sensitive data and handled with heightened care.
10.4 You may request access, correction, or deletion of your data, subject to legal retention requirements.

11) Safety, Hygiene & Contraindications
11.1 Clients must arrive in a condition suitable for treatment and free of contagious illness.
11.2 If symptoms of contagious illness are present, LUMA HAVEN may decline to proceed. Cancellation fees may still apply.
11.3 Techniques may be modified or declined where contraindicated.

12) Products, Aromatics & Allergies
12.1 Aromatic support is optional and used at low intensity.
12.2 Clients are responsible for disclosing sensitivities or allergies in advance.
12.3 Fragrance-free care is available upon request.

13) Gift Vouchers & Packages
13.1 Gift vouchers are non-refundable and not redeemable for cash.
13.2 Validity periods and applicable terms are stated at purchase.
13.3 Lost or stolen vouchers cannot be replaced without verified proof of purchase.

14) Chargebacks & Payment Disputes
14.1 Clients agree to contact LUMA HAVEN directly to resolve concerns prior to initiating payment disputes.
14.2 Unjustified chargebacks may result in recovery actions and refusal of future bookings.
14.3 LUMA HAVEN reserves the right to recover administrative costs, legal expenses, and associated damages permitted under applicable law.

15) Limitation of Liability
15.1 To the maximum extent permitted under Dutch law, liability is limited to the amount paid for the specific session giving rise to the claim.
15.2 LUMA HAVEN is not liable for indirect or consequential damages, including lost profits, travel costs, or missed opportunities.
15.3 Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted under applicable law.

16) Force Majeure
16.1 LUMA HAVEN is not responsible for delay or inability to perform services due to circumstances beyond reasonable control, including but not limited to illness, severe weather, transport disruption, government restrictions, or emergency events.
16.2 Where possible, rescheduling will be offered. Refunds are at the sole discretion of LUMA HAVEN depending on incurred costs.

17) Intellectual Property
17.1 All content, treatment design, written materials, branding, and methods remain the intellectual property of LUMA HAVEN and may not be copied or reproduced without written permission.

18) Complaints & Resolution
18.1 Any concerns must be communicated within 7 days of the session.
18.2 The parties agree to attempt private resolution in good faith before initiating formal legal proceedings.

19) Governing Law
19.1 These Terms are governed by the laws of The Netherlands.
19.2 Any disputes shall be submitted to the competent court in The Netherlands unless mandatory consumer law dictates otherwise.

20) Addendum for Private / High-Sensitivity Engagements
20.1 Certain bookings, including private residence, hotel, yacht, estate, or security-managed environments, may require a separate Private Client Addendum.
20.2 Where issued, such Addendum forms part of this Agreement and may include enhanced confidentiality, security protocols, retainer structures, and travel terms.

21) Indemnification
21.1 You agree to indemnify and hold harmless LUMA HAVEN from claims arising from undisclosed health conditions, misuse of services, third-party claims related to session locations, or actions beyond the Practitioner’s reasonable control, to the maximum extent permitted under applicable law.
21.2 This clause does not apply in cases of proven gross negligence.

22) Non-Solicitation
22.1 Clients agree not to solicit, hire, or contract the Practitioner outside the formal structure of LUMA HAVEN in a manner that circumvents agreed booking procedures or payment structures.

23) Severability
23.1 If any provision of these Terms is deemed unenforceable, the remaining provisions remain in full force.

24) Survival
24.1 Provisions relating to confidentiality, liability limitation, indemnification, intellectual property, dispute resolution, and any provisions which by their nature are intended to survive shall remain in effect after termination of services.
